Terms of Service

• Orders placed on the site are for in-person pickup. We'll share pickup details after your payment is confirmed.
• Everything is baked in small batches, so availability can change and some items may sell out.
• Please pick up your order during the window we communicate. We can't guarantee freshness or hold items indefinitely for late pickups.

• Prices are shown in U.S. dollars. Applicable sales tax is added at checkout.
• Payment is collected at checkout through Stripe. Placing an order authorizes the charge shown.
• If a price or item is listed in error, we may cancel the affected order and refund you.

• You earn loyalty points and punch-card credit on paid orders.
• When your punch card is complete you earn a free-dessert reward, up to the value shown in the program at that time.
• Points and rewards have no cash value and can't be transferred or sold.
• If an order is refunded, the points and punches earned on it may be reversed, and an unused reward earned from it may be revoked.
• We may adjust or end the loyalty program; we'll honor rewards already earned where reasonable.

Because items are made fresh in small batches, an order may not be cancellable once we've started baking it. If something isn't right with your order, contact us as soon as possible and we'll make it right. Refunds are handled at our discretion and in line with applicable law.

Our desserts are made in a kitchen that also handles wheat, eggs, dairy, nuts, peanuts, and soy. We can't guarantee any item is free from allergen cross-contact. If you have a food allergy, please contact us before ordering and order at your own discretion.

You're responsible for keeping access to the Google account you sign in with secure, and for activity placed through your account. Let us know right away if you believe your account has been used without your permission.

Please use the site only to browse and place genuine orders. Don't attempt to disrupt, attack, or gain unauthorized access to the site or other customers' information.

The site is provided on an "as is" basis. To the fullest extent permitted by law, Desserts by Gene isn't liable for indirect or incidental damages arising from use of the site. Nothing in these terms limits liability that can't be limited under applicable law.

We may update these terms from time to time. When we do, we'll revise the "Last updated" date above. Continued use of the site means you accept the current terms.
